Welcome to JitsPack. These Terms and Conditions (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

“JitsPack,” “we,” “us,” and “our” refer to JitsPack LLC, and “you” and “your” refer to the person or entity using the Services.

1. Eligibility

By using the Services, you represent that:

  • You are at least the age of majority in your jurisdiction, and
  • You have the legal capacity and authority to enter into these Terms.

If you use the Services on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on our website and update the “Last updated” date.

Your continued use of the Services after changes become effective means you accept the revised Terms.

3. Use of the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Services for any illegal, harmful, or abusive purpose.
  • Interfere with or disrupt the security or operation of the Services.
  • Attempt to gain unauthorized access to any part of the Services, accounts, or systems.

If a product is not as described, your sole remedy is to return it in unused condition, subject to our Returns & Refunds section below.

6. Orders, Pricing, and Payment

6.1 Order Acceptance

All orders placed through the website are offers to purchase products under these Terms. We may accept, reject, or cancel any order at our sole discretion, including for reasons such as:

  • Product unavailability
  • Errors in pricing or product information
  • Suspected fraud or unauthorized activity
  • Problems with payment processing

Your order is considered accepted only when we send an order confirmation (e.g., via email).

6.2 Pricing

  • All prices are listed in USD, unless stated otherwise.
  • Prices do not include taxes, customs duties, or shipping charges unless explicitly stated.
  • We may change prices at any time without prior notice. The price you pay is the price displayed at checkout at the time you place your order, plus applicable taxes and fees.

6.3 Payment

By providing a payment method, you represent and warrant that you are authorized to use that payment method and authorize us (or our third-party payment processors) to charge the full amount of your order, including taxes, shipping, and any other applicable charges.

We are not responsible for errors by payment processors or financial institutions.

7. Shipping, Risk of Loss, and Delivery

  • We will arrange shipping of the products to the address you provide at checkout.
  • Shipping and delivery dates are estimates only and not guaranteed.
  • Risk of loss and title for products pass to you upon our delivery to the carrier.

You are responsible for providing accurate shipping information. We are not liable for delays or failures in delivery due to incorrect or incomplete information, carrier issues, or events beyond our reasonable control (e.g., weather, strikes, customs delays).

8. Returns, Exchanges, and Refunds

Our returns and refunds policy is incorporated into these Terms by reference and may be updated from time to time.

  • Condition of items (e.g., unused, in original packaging, proof of purchase).
  • Non-returnable items (e.g., clearance, custom items, heavily used items).
  • Who pays return shipping.

If there is a conflict between these Terms and any separate returns policy posted elsewhere, the posted policy will control for returns and refunds.

9. Product Use and Safety

JitsPack products may be used for everyday carry and related purposes. You are solely responsible for:

  • Evaluating whether our products are suitable for your intended use.
  • Using products in a safe, lawful, and responsible manner.
  • Ensuring products are not used or modified in a way that could create hazards.

We are not responsible for:

  • Loss, theft, or damage to the items you carry in or on our products.
  • Improper use, misuse, alteration, or unauthorized modification of our products.
  • Use of our products with third-party items or accessories.

10. Intellectual Property

All content and materials provided through the Services—including but not limited to logos, trademarks, trade dress, product designs, text, images, graphics, videos, and software—are owned by or licensed to JitsPack and are protected by copyright, trademark, and other intellectual property laws.

Except as allowed by law or expressly authorized by us in writing, you may not:

  • Copy, reproduce, modify, adapt, distribute, or create derivative works from the content.
  • Use any JitsPack trademark, logo, or trade dress without our prior written permission.
  • Use our content for any commercial purpose not expressly permitted.

Any unauthorized use of our intellectual property may result in civil and/or criminal penalties.

11. User Content and Feedback

If you submit content to us (such as reviews, photos, comments, suggestions, or feedback) (“User Content”), you grant JitsPack a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from that User Content in any media.

By submitting User Content, you represent and warrant that:

  • You own or control all rights to the User Content.
  • The User Content does not infringe the rights of any third party.
  • The User Content is truthful and not misleading.
  • The User Content complies with all applicable laws and these Terms.

We may remove or refuse to display any User Content at our sole discretion.

12. Third-Party Services and Links

The Services may contain links to third-party websites, services, or resources that are not owned or controlled by JitsPack.

  • We do not endorse, and are not responsible or liable for, any third-party websites or services.
  • Your use of third-party services is at your own risk and may be subject to their terms and privacy policies.

13. Disclaimer of Warranties

To the fullest extent permitted by law:

  • The Services and all products are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory.
  • We specifically disclaim any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Without limiting the foregoing, we do not warrant that:

  • The Services will be uninterrupted, secure, or free of errors or viruses.
  • Any defects or errors will be corrected.
  • The information available through the Services is accurate, complete, or current.

Your use of the Services and products is at your own risk.

14. Limitation of Liability

To the fullest extent permitted by law, JitsPack and its owners, officers, employees, contractors, and agents will not be liable for any:

  • Indirect, incidental, special, consequential, or punitive damages, or
  • Losses of profits, revenue, data, goodwill, or other intangible losses,

arising out of or in connection with your use of the Services or products, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

To the extent any liability is found despite the above, our total cumulative liability for all claims arising out of or related to the Services or products will not exceed the greater of:

  1. The amount you paid to us for the product or service giving rise to the claim; or
  2. $100 (USD).

Some jurisdictions do not allow certain exclusions or limitations of liability, so some of the above may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless JitsPack and its owners, officers, employees, contractors, and agents from and against any and all claims, demands, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

  • Your use of the Services or products;
  • Your violation of these Terms;
  • Your violation of any law or rights of a third party;
  • Any User Content you submit.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with us in such defense.

16. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

We may, at our sole discretion and without prior notice, suspend or terminate your access to the Services, including your account, if we believe you have violated these Terms or if we choose to discontinue the Services.

Upon termination, all provisions that by their nature should survive termination will survive, including but not limited to ownership provisions, warranty disclaimers, limitations of liability, and indemnity.

18. Governing Law and Dispute Resolution

These Terms and your use of the Services will be governed by and construed in accordance with the laws of Georgia, USA, without regard to conflict of law principles.

You agree that any legal action or proceeding arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Atlanta, Georgia, and you consent to the jurisdiction and venue of such courts.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.

20. No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

21. Entire Agreement

These Terms, together with any other policies or agreements expressly incorporated by reference (such as our Privacy Policy and Return Policy), constitute the entire agreement between you and JitsPack regarding the Services and products and supersede any prior or contemporaneous agreements.
